“Seasonal Camper or Camper” refers to you.
“RV” refers to your camping unit.
“Site or Campsite” refers to your designated site #.
“Campground or RV Park or Owner” refers to Birch Creek RV Park, LLC.
“Guest or Invitee” refers to camper’s guest or invitee.
This Agreement gives Seasonal Camper, Spouse, and Children the right to occupy Site No. _ with no more than one RV or other approved living unit, or any other type of structure. Trailers, only classed as RV Camping Units, are permitted. (Defined as a RVIA Approved Recreational Vehicle) The RV Park Conditional Use Permit issued by the Village of Birchwood further limits RV units to being “10 years old or older coming into the park are subject to inspection by the Village of Birchwood Park Committee. Should any RV be found in unacceptable condition by the Committee, it must be removed from the Park within 7 days.” The RV Park owner also reserves the right to limit size, age, and condition of the RV allowed on the site.
The seasonal camping rate is $ __ , plus 5 ½% sales tax and runs from April 15, __ to October 15, __ . All seasonal camper fees are to be paid in full by July 1st• The first installment (1/2 of the seasonal rate) shall be paid May 1st, and the final payment is due by July 1st• There shall be no refunds on seasonal camping rates once the season has started. A 1-1/2% interest fee shall be assessed per month on any unpaid balance after July 1st•
Due to the high cost of sewer and water, guests staying in your camper MAY be charged $3.00 per person per day. All guests must register with the Campground owner. No Winter access will be provided at this time.
A deposit of $500.00 will be required by October 15th of each year to reserve your site for the following season. The deposit will be deducted from the total remaining due. The remaining balance will be due by May 1st• There are no refunds once the season has started.
The use of the site is personal to the Camper and the Camper shall not transfer, sell, assign, or sublease such site. This contract Agreement shall terminate upon the sale or removal of your RV. No Refunds of the seasonal camping rate! The sale of your RV does not guarantee a site for the purchaser. The new purchaser must be accepted by the owner of Birch Creek RV Park for a new seasonal contract agreement. Seasonal Camper shall notify Birch Creek RV Park management in advance of temporarily taking out their RV and the duration of their absence. The Birch Creek RV Park owner reserves the right to rent out the site during any absence of the Seasonal Camper and his/her RV.
Winter storage will be $150.00 and shall be due no later than November 1st• Seasonal Campers will not be charged winter storage fee if they submit their deposit for the next season by October 15th, as defined above. Seasonal Campers not returning the following year must remove their camper by October 15th or as agreed. If the Seasonal Camper fails to remove their RV, Birch Creek RV Park reserves the right to remove the RV and the Seasonal Camper shall pay all costs of the removal and storage. Birch Creek RV Park will not be held responsible or pay for any damages caused to the RV upon removal or storage.
Per our insurance carrier, Seasonal Camper must provide a copy of their own liability, fire, wind, and other hazard insurance on their personal property, including their RV, and provide a copy to the park owner by April 1st•
Golf cart and ATV/UTV owners must also have a certificate of insurance from their insurance company.
You must be a licensed or certified driver to operate golf carts or ATV/UTV’s on Birch Creek RV Park property.
All seasonal sites will be billed as metered, plus a $10 meter fee monthly.
Sewer and Water
All sites are on the Village of Birchwood sewer and water. This service is included in the seasonal site rate above. Water usage outside of the RV (washing vehicles/ATV/UTV’s) must be metered due to the high cost of water/sewer. Please contact Birch Creek RV Park owner for this meter.
Please compact garbage in plastic bags and break down all boxes/cardboard prior to disposing in the provided dumpster. Please do not clean or dispose of any fish cleanings on site. A fish cleaning facility is available at Doolittle Park. OR All fish must be cleaned at fish cleaning stations. Please wrap all fish remains in newspaper and then in plastic bags provided. All fishermen must put bagged fish remains in the freezer marked – not in the trash or dumpster.
Internet will be available for purchase from several service providers though links provided at each camping site. It will be up to the Seasonal Camper to make arrangements and pay for their desired internet service.
Seasonal Campers shall be responsible for keeping their site clean and neat. Keep grass cut in back, front, and under the unit, and trimmed around the site. In the event the Seasonal Camper fails to keep site maintained, notice of the deficiency may be given by phone, mail, or email. Seasonal Camper will have 10 days to fulfill the obligations unless arrangements have been made with the RV Park owner. If maintenance is not performed, a $25.00 to $100.00 clean up or removal fee per incident may be charged.
No additions/attachments to RV’s are permitted other than decks. Decks can be 8 ft. wide by a setback of 3 ft. from each end of the RV, not including the tongue, unless there is a door. Seasonal Camper is responsible for restoring the lawn after deck removal and/or removal of their RV. Sheds 6 ft. x 8 ft. for storage purposes. one per site, are only available thru park owners.
Campsite parking is for your vehicle and/or ATV/UTV only. Trailers, boats, and additional vehicles must be parked in the overflow parking lot. Please do not park on the grass or in another site. ATV’s/UTV’s can be parked on the grass while RV is in use, on gravel when you leave.
Individual fire pits are permitted at each site. Fire pit rings will be provided by the Birch Creek RV Park owner. Fire pit rings must be placed a minimum of 5 ft. away from all camping units, building structures, and motor vehicles. No outside firewood is to be brought to the RV Park property. Firewood will be available for purchase from Birch Creek RV Park. (Dead sticks and wood found around your site can be used for burning)
Generators are only allowed to be used in the event of a power failure.
Other (Per Village of Birchwood Ordinances)
RV Park residents are subject to Village of Birchwood Ordinances.
Pets are welcome but must be leashed at all times and cleaned up after. Unattended barking dogs will not be tolerated.
Fireworks are not permitted in the park.
Quiet Time is 11 :00 pm
Seasonal Camper, and invitee or guest, shall indemnify and hold harmless Birch Creek RV Park and its employees from all claims, actions, damages, liabilities, and expenses, including attorney’s fees, for any accident, injury, or damage to any person or property in connection with Birch Creek RV Park and its facilities.
RV Park Owner shall have no responsibility whatsoever for loss of, or damage to property of Seasonal Camper or injuries or death of persons from any cause whatsoever, including, but not limited to fire, theft, or the elements.
The RV Park Owner reserves the right to terminate this contract Agreement at any time for just cause.
